Singapore
At the forefront of potential investment by Mosaic’s Litigation Capital Fund is Singapore, which is being increasingly recognized as a commercial hub in Southeast Asia.
Mosaic envisages Singapore as being a growth opportunity for the next five (5) to ten (10) years, at a minimum. Of particular note, Singapore has imposed a requirement to maintain a certain level of sophistication in the litigation funding space that a litigation fund qualify by having a paid- up share capital of not less than S$5M or not less than S$5M in managed assets.
Hong Kong
Hong Kong is another jurisdiction for potential litigation funding opportunities. Just as with Singapore, insolvency proceedings are also exempt from third-party litigation funding prohibitions.
Furthermore, to keep up with the modernization of the Singapore court system, Hong Kong appears to be considering the possibility of further reforms in the near future to allow for more flexibility in the litigation funding space. With that being said, Mosaic considers it to be an opportune time to establish itself within the Hong Kong litigation funding marketplace.
Thailand
Thailand is another country in Southeast Asia that has not specifically made a prohibition against litigation funding. Therefore, Thailand presents yet another opportunity for Mosaic within Southeast Asia.
Vietnam
Although Vietnam is silent on the permissibility of third-party litigation funding, substantive litigation funding agreements – amounting to $30M in one instance — have been entered into in the last few years without much in the way of opposition.
Given the practical precedent that has been set forth, and the potential economic growth of Vietnam (being one of the only countries in 2020 to post GDP growth), Mosaic views Vietnam as another underserviced market with significant upside potential in the litigation funding space.
